The conference about underwater space and its juridical dimension, hosted by the Law School of the University of Milano Bicocca, which is in a rapidly evolving context with technological and scientific innovations as well as international subjects of law and regulations at sea. It was centered on a discussion about the jurisdiction of submarine space.
The event started from a perspective on the current framework of maritime jurisdiction and its main challenges of the submarine spaces. It displayed present projects and initiatives, at academic, public and private collaborations to target these challenges both in national and international law, as subsequently arising opportunities in the evolution of the juridical regulation of such spaces.
Two main National-scale initiatives of Italy as a country were presented:
A National Pole for Underwater domain
A National Agency for Safety of Underwater Activities
Both the initiatives address the uncertainty in the ocean volume, which is unexplored for more than 80% and the seabed is unmapped for more than 95%, they address the unregulated and uncertain domain of underwater security and protection from free uses of the marine environment and its resources.
The juridical discussion carries the interest toward the national scale implementation of regulations and initiatives, to then consider the plausible setting of standards and procedures of safety and others uses to be then transferred and adapted to international juridical maritime instruments.
The Maritime and underwater industries bring the oppurtunities to discover, qualify and quantify the maritime risks, to have them implemented into insurance strategies and into business models and strategic considerations.
for the academia and research institutes, the role of pioneering studies and applied research projects remains fundamental as input of problem solving and innovation on maritime value chains and their efficiency or scaling capabilities.
The underwater domain seems very unknown, yet it represent a space for very high identity and opportunities for coastal but also land-locked countries, as the sea definitely represent a space of social evolution, commerce, culture and innovation exchange.
